1. Acceptance of Terms
By accessing or using the HealthBit Technology PLC ("HealthBit," "we," "us," or "our") telehealth platform and associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the Service.
2. Description of Service
The Service provides a platform to connect patients with licensed healthcare professionals ("Providers") for remote telehealth consultations via video, audio, or text. HealthBit provides the technology platform and administrative support; medical services are provided solely by the independent Providers.
THE SERVICE IS NOT FOR MEDICAL EMERGENCIES.
The Service is intended for non-emergency medical consultations, advice, diagnosis, and potential treatment for certain conditions. It may not be a substitute for your primary care physician or in-person medical evaluation.
3. User Accounts
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your password and identification.
- Notify us immediately of any unauthorized use of your account.
- Accept responsibility for all activities that occur under your account.
4. User Conduct
You agree not to use the Service:
- For any unlawful purpose or in violation of any local, state, national, or international law.
- To impersonate any person or entity or otherwise misrepresent your affiliation.
- To harass, abuse, or harm another person.
- To transmit any material that is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.
- To interfere with or disrupt the Service or servers or networks connected to the Service.
5. Medical Disclaimer and Provider Relationship
HealthBit does not provide medical advice or care. We provide the technology platform that enables you to connect with Providers who are solely responsible for the medical services they provide.
The information provided through the Service by Providers is based on their professional judgment and the information you provide. It is not guaranteed to be accurate or complete. You are responsible for providing accurate and complete information about your health.
Your interaction with a Provider through the Service establishes a doctor-patient relationship solely between you and that Provider. HealthBit is not a party to that relationship.
HealthBit does not endorse any specific Provider and makes no representations or warranties about their qualifications or the quality of care they provide.
6. Payment and Fees
You agree to pay all fees associated with your use of the Service as described on the platform (e.g., consultation tariffs). Payments may be processed through integrated methods like airtime deduction or mobile money (e.g., Telebirr). By providing payment information, you authorize us or our third-party payment processors to charge the applicable fees.
7. Intellectual Property
The Service and its original content (excluding content provided by users or Providers), features, and functionality are and will remain the exclusive property of HealthBit Technology PLC and its licensors. The Service is protected by copyright, trademark, and other laws of Ethiopia and foreign countries.
8. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.
You may terminate your account at any time by contacting customer support or using account deletion features if available.
9. Disclaimers of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. USE OF THE SERVICE IS AT YOUR OWN RISK. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. HEALTHBIT DOES NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS; THAT THE SERVICE WILL BE AVAILABLE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; OR THAT THE RESULTS OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HEALTHBIT, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE. HEALTHBIT'S LIABILITY IS LIMITED REGARDING THE MEDICAL ADVICE PROVIDED, AS THAT IS THE RESPONSIBILITY OF THE INDEPENDENT PROVIDERS.
11. Indemnification
You agree to defend, indemnify, and hold harmless HealthBit Technology PLC and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the Service.
12. Governing Law
These Terms shall be governed and construed in accordance with the laws of Ethiopia, without regard to its conflict of law provisions.
13. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 15 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
